1. Acceptance of Terms
By accessing and using Mobile Meals Center ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
Mobile Meals Center is an online platform that connects customers with local restaurants for food ordering and delivery services. We facilitate:
- Online food ordering from partner restaurants
- Payment processing for orders
- Coordination of food delivery services
- Customer support and order management
3. User Accounts
Account Registration
To use certain features of our service, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
Account Types
- Customer Accounts: For ordering food and managing deliveries
- Restaurant Accounts: For managing menus, orders, and restaurant information
4. Ordering and Payment
Order Placement
When you place an order, you agree that:
- All order information is accurate and complete
- You have authorization to use the payment method provided
- You will be available to receive the order at the specified address
- Orders are subject to restaurant availability and acceptance
Recurring Orders
Mobile Meals Center offers recurring order services for automatic delivery of your favorite meals. When you create a recurring order, you agree that:
- Payment Options: You may choose to pay per order or pre-pay for designated periods (1, 3, 6, or 12 months)
- Pre-payment Discounts: Pre-paid orders receive discounts: 1 month (5%), 3 months (10%), 6 months (15%), 12 months (20%)
- Credit System: Pre-paid amounts are credited to your recurring order account and deducted as orders are executed
- Validity Period: Pre-paid credits are valid for the selected period and expire if not used
- Automatic Renewal: Recurring orders will continue automatically until credits are exhausted or you cancel
- Price Changes: Pre-paid orders lock in the price at time of payment, protecting you from price increases
- Modification Rights: You can modify frequency, schedule, or payment period before next execution
Pricing and Payment
- All prices are listed in Kenyan Shillings (KES)
- Prices include applicable taxes and delivery fees
- Payment is processed securely through our payment partners
- We accept credit/debit cards, M-Pesa, and cash on delivery
- Pre-payment Processing: Pre-payments are processed immediately and credits are added to your account
- Refund Policy: Pre-paid amounts are refundable on a pro-rata basis for unused credits
Cash on Delivery Payment Policy
Important: For cash on delivery orders, customers are required to pay a 60% deposit upfront via card or M-Pesa payment. The remaining 40% balance is to be paid in cash upon delivery.
- Deposit Requirement: 60% of the total order amount must be paid at checkout
- Balance Payment: The remaining 40% is paid in cash when you receive your order
- Payment Methods for Deposit: Credit/Debit card or M-Pesa
- Exact Change: Please have the exact balance amount ready for the delivery person
- Refund Policy: If an order is cancelled after deposit payment, the deposit will be refunded within 5-7 business days
- Order Confirmation: Your order is only confirmed after the deposit payment is successfully processed
5. Recurring Orders and Pre-payments
Service Description
Our recurring order service allows you to schedule automatic deliveries of your favorite meals. Pre-payment options provide significant savings and convenience.
Pre-payment Terms
- Payment Processing: Pre-payments are processed immediately upon successful transaction
- Credit Allocation: Pre-paid amounts are converted to order credits and stored in your account
- Price Protection: Pre-paid orders lock in current menu prices, protecting you from future increases
- Discount Application: Discounts are applied automatically based on selected payment period
- Validity Period: Credits are valid for the exact duration purchased (1, 3, 6, or 12 months)
Automatic Renewals
- Renewal Timing: Automatic renewal attempts occur 7 days before credit expiration
- Payment Method: Renewals use the same payment method as initial purchase
- Failure Handling: If renewal fails after 3 attempts, recurring order is paused
- Notification: You'll receive email notifications for successful renewals, failures, and credit expiration
Credit Management
- Credit Tracking: You can view available credits and expiration dates in your recurring orders dashboard
- Usage Monitoring: Credits are deducted automatically as orders are processed
- Manual Top-up: You can add additional credits at any time
- Transfer Restrictions: Credits are non-transferable between recurring orders or users
Limitations and Exclusions
- Restaurant Availability: Recurring orders depend on restaurant being operational and menu availability
- Delivery Area: Service limited to restaurants within our delivery coverage areas
- Menu Changes: If menu items become unavailable, recurring orders will be paused until resolved
- Price Adjustments: Pre-paid credits maintain original pricing; new pricing applies to additional purchases
- Force Majeure: We are not responsible for service interruptions due to events beyond our control
6. Delivery Terms
Delivery services are subject to the following terms:
- Delivery times are estimates and may vary due to weather, traffic, or other factors
- You must provide accurate delivery address and contact information
- Someone must be available to receive the order at the delivery address
- Delivery fees are clearly displayed before order confirmation
- We are not responsible for orders delivered to incorrect addresses due to customer error
6. Cancellations and Refunds
Order Cancellation
Orders may be cancelled:
- By customers within 5 minutes of placement (before restaurant confirmation)
- By restaurants if they cannot fulfill the order
- By Mobile Meals Center in case of technical issues or safety concerns
Refund Policy
- Full refunds for cancelled orders before preparation begins
- Partial refunds may be issued for missing or incorrect items
- Refunds are processed within 5-7 business days
- Cash on delivery orders receive refunds via M-Pesa or bank transfer
- Recurring Order Refunds: Pre-paid recurring orders are refundable on a pro-rata basis for unused credits
- Credit Expiration: Unused pre-paid credits expire 30 days after the end of the selected payment period
- Early Cancellation: No penalty for cancelling recurring orders; remaining credits are available for future use
- Payment Failure Refunds: If automatic payment fails for pre-paid renewals, you'll be notified and given 7 days to update payment method
7. Restaurant Partner Obligations
Restaurant partners agree to:
- Maintain accurate menu information and pricing
- Prepare orders according to customer specifications
- Maintain food safety and quality standards
- Respond to orders within reasonable timeframes
- Comply with local health and safety regulations
8. Prohibited Uses
You may not use our service to:
- Violate any local, state, national, or international law
- Transmit or procure harmful or malicious code
- Collect or harvest personal information from other users
- Impersonate another person or entity
- Interfere with or disrupt the service or servers
- Use the service for fraudulent or unauthorized purposes
9. Intellectual Property
The Mobile Meals Center platform, including its design, functionality, and content, is protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or distribute our content without permission
- Use our trademarks or logos without authorization
- Reverse engineer or attempt to extract source code
- Create derivative works based on our platform
10. Limitation of Liability
Mobile Meals Center shall not be liable for:
- Food quality, safety, or preparation issues (restaurant responsibility)
- Delivery delays due to external factors
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Actions or omissions of third-party service providers
Our total liability shall not exceed the amount paid for the specific order in question.
11. Indemnification
You agree to indemnify and hold harmless Mobile Meals Center, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the service
- Your violation of these terms
- Your violation of any third-party rights
- Any content you submit or transmit through the service
12. Termination
We may terminate or suspend your account and access to the service:
- For violation of these terms of service
- For fraudulent or suspicious activity
- At our sole discretion with or without notice
- Upon your request to delete your account
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
14. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes by:
- Posting updated terms on our website
- Sending email notifications to registered users
- Displaying notices on our platform
Continued use of the service after changes constitutes acceptance of the new terms.
